FUNDS AVAILABILITY DISCLOSURE

 

The following is a statement of our policy concerning your ability to draw against funds from deposits you make to accounts you hold with us.  Our policy is to delay the availability of funds that you deposit to your account.  During this delay, as set forth below, you may not withdraw the funds in cash.  Please remember that even after we have made funds available to you, and you have withdrawn funds, you are still responsible for checks you deposit that may be returned to us unpaid for any reason, and for any other problems involving

GENERAL AVAILABILITY DETERMINATION - The length of the delay is counted in business days from the day of your deposit.  Each day is a business day except Saturdays, Sundays, and Federal and State holidays.  If you make a deposit in person at any of our branches before 2:00 PM on a business day that we are open, we will consider that day to be the day of your deposit.  However, if you make a deposit in person at any of our branches after 2:00 PM or on a day that we are not open, we will consider that the deposit was made on the next business day that we are open. For deposits made at an ATM owned by The Community National Banks, the cutoff time will be 1:00 PM.

SAME DAY AVAILABILITY - Funds electronically deposited to your account (i.e. pre-authorized credits, direct deposits) and cash deposited in person to an employee of The Community National Bank will be available the day we receive the deposit.

NEXT DAY AVAILABILITY - Funds from the following deposits are available on the first business day after the day of your deposit:

* US Treasury checks that are payable to you

* Checks drawn on The Community National Bank

* Wire Transfers

 

If you make a deposit in person at The Community National Bank, funds from the following deposits will also be available on the first business day after the day of your deposit:

* State and local government checks payable to you if you use a special deposit slip available from any of our bank tellers.

* Cashiers, certified, and tellers checks that are payable to you if you use a special deposit slip available from any of our bank tellers.

* Federal Reserve Bank checks, Federal Home Loan Bank checks, and postal money orders that are payable to you if you use a special deposit slip available from any of our bank tellers.

 

Funds from deposits made at a CNB ATM will be available one business day following the date of deposit.

DELAYS IN OTHER CHECK DEPOSITS - Delays in other check deposits depend on whether the check is a local or non-local check.  To determine whether a check is local or non-local, look at the routing number located in the bottom portion of the check. Local checks are those that have the following first four (4) digits in the routing number: 0410, 0412, 0420, 0421, 0422, 0423, 0430, 0432, 0433, 0434, 0440, 0441, 0442, 2410, 2412, 2420, 2421, 2422, 2423, 2430, 2432, 2433, 2434.

There may be occasions when we treat the check as local or non-local based on the location of the check and not the routing number. yes">  An example of this would be a situation where a Credit Union share draft is payable by a Credit Union that is located in the same check processing region as The Community National Bank. yes">  This share draft will be treated as a local check even if the same draft is payable through a bank that is located outside our check processing region as determined by the routing number on the check.

Local Checks - Our policy is to make funds available from local checks on the first business day after the day of your deposit to pay checks you have written to others.  Example: On Monday before 2:00 PM, you deposit a local check for $500.00. This entire amount is available on Tuesday.

Non-Local Checks - If you deposit a non-local check, the first $100.00 of that deposit will be available on the first business day after the day of your deposit.  The balance of the funds will be available on the third business day after the day of your deposit.  Example: On Monday before 2:00 PM, you deposit both local and non-local checks.  $100.00 from the checks will be available on the first business day after the day of your deposit, not $100.00 from each category of checks.  The remainder of funds will be available on Thursday.

 

CHECKS DRAWN ON OTHER BANKS

Check Cashing - If we cash a check for you drawn on another bank, we may withhold the availability of a corresponding amount of funds that are already on deposit in your account.  These funds will be available at the time funds from the check we cashed would have been available if you had deposited it.

Check Deposit - If we accept a check drawn on another bank for deposit, we may make funds from the deposit available for withdrawal immediately but delay your ability to withdraw a corresponding amount of funds that you have on deposit in another account with us.  The funds in the other account would then not be available for withdrawal until the time periods described in this disclosure for the type of check you deposited.

WHEN LONGER DELAYS APPLY - Funds you deposit by check may be delayed for a longer period under the following circumstances:

* We have reason to believe a check you deposit will not be paid.

* You redeposit a check that has been returned unpaid.

* You have repeatedly overdrawn your account in the last six (6) months.

* There is an emergency such as failure of communication or computer equipment

We will notify you if we delay your ability to withdraw funds for any of these reasons and will tell you when the funds will be available.   Generally, funds will be available no later than the eleventh business day after the day of your deposit.

 

AVAILABILITY OF AUTOMATED TELLER MACHINE (ATM) DEPOSITS

The length of the delay is counted in business days from the day of your deposit.  Every day is a business day except Saturdays, Sundays, and federal holidays.  If you make a deposit of cash or checks at an ATM owned by The Community National Bank before 12:00 PM on a business day that we are open, we will consider that business day to be the day of your deposit.  However, if you make a deposit of cash or checks at an ATM owned by The Community National Bank after 12:00 PM or on a day that we are not open, we will consider that the deposit was made on the next business day we are open.  All deposits made at an ATM owned by The Community National Bank will be available one business day following the date of deposit.  All ATMs owned or operated by The Community National Bank are clearly defined as such.
